The bit
A teenager walks home from practice. Two board members intercept him on the sidewalk with a clipboard and a lanyard, because they have just learned what NIL means and they have questions about whether his likeness, generated on association common area, belongs to the association.
It does not. But the paperwork has already been drafted.
The part that isn’t a bit
Every ad you have ever seen for a roofer, a landscaper or a pest-control company uses a stock photo of a family who does not live anywhere near you. Meanwhile the most persuasive advertisement on your street is the neighbor who actually had the roof done and will not stop talking about it.
So: let residents license their own name, image and likeness to the local businesses advertising into their community — and route the money back against their HOA dues.
You opt in
You choose to be in it. Nobody is filmed by surprise, and nobody’s likeness gets used because a board voted on it at a meeting you didn’t attend.
A local business books you
The HVAC company that just did your system would rather show you than a stock model. You’re credible because you’re real and you’re local.
It lands on your statement
Your share goes against your assessment. The first person on your street to do this becomes very popular at the annual meeting.

What the board does not get
- Your likeness is yours. Living in a community association does not assign it to anyone.
- An HOA cannot license you to a third party, and it cannot take a cut of a deal you signed.
- Common area is where you walk. It is not a rights-clearing jurisdiction.
- If anyone hands you a document suggesting otherwise, read it slowly, then have a lawyer read it faster.
