1. Agreeing to these terms

By using DrinkingAndHOAing.com (the “Site”), you agree to these Terms of Use. If you don’t agree, please don’t use the Site. If you use the Site on behalf of an organization — an association, a management company, a business — you’re confirming you have the authority to accept these terms for them.

2. This is satire

Drinking and HOAing is a work of comedy. Every board member, homeowner, inspector, community, violation notice, goose and incident report on this Site is fictional. Names and characters are invented. Any resemblance to a real person, a real association, or a real dispute is coincidental — and, we accept, occasionally uncanny.

Video content on this Site is produced using generative AI tools. The people you see in it are not real people, and nothing depicted actually happened.

3. Nothing here is legal advice

Some pages on this Site — the HOA rights guide, the glossary, and the Help Hotline — contain general information about how community associations work. That is general information, not legal advice, and we are not your lawyers.

HOA law varies enormously between states and is overridden by your own governing documents. The Help Hotline in particular is a comedy bot, not an attorney. For anything involving money, a fine, a lien, a deadline, or a court date, talk to an attorney licensed where you live.

4. What you can and can’t do here

You may read, watch, link to and share anything on the Site. Please don’t:

• Use the Site to harass, threaten, defame or target a real person or a real community.
• Post or submit anything unlawful, hateful, or sexually explicit.
• Present our satire as fact, or edit it so it appears to depict a real, identifiable person.
• Scrape, mirror or bulk-download the Site, or use it to train a model, without our written permission.
• Break, probe or overload the Site, or try to get at parts of it that aren’t public.
• Impersonate anyone, including us.

We can suspend access or remove content for any of the above, without notice.

5. Who owns what

The Site — the videos, writing, characters, designs, logos, and the Drinking and HOAing name and marks — belongs to us or our licensors. You get a personal, non-exclusive, revocable licence to view and share it as the Site allows. That’s it: no reselling, no re-uploading our videos to your own monetized channel, no merchandise using our marks.

Sharing a link, embedding the player, or reposting a clip with credit and a link back is fine and encouraged. If you want to use something commercially, ask us first.

6. Anything you send us

Stories, violations, reviews, nominations, tryouts and roster signups are covered by a separate document: the Submission Terms. Read those before you send anything. They explain exactly what permission you’re giving us and what we promise in return.

7. Advertising, deals and the savings program

The Site describes an advertising network and a community savings program. Two things to be clear about:

• Nothing on this Site is a promise of savings. Figures shown are illustrative examples, not projections, offers, or guarantees. Any actual arrangement with a community or an advertiser would be governed by its own signed agreement.
• We don’t control third parties. Deals, vendors, contractors and advertisers listed or linked here are independent businesses. We don’t guarantee their work, their pricing, or their availability, and any dealings you have with them are between you and them.

8. Links to other sites

We link out to third-party sites and load third-party services (analytics, our email provider, social share endpoints). We don’t control them and we’re not responsible for their content or their privacy practices. Their terms apply when you’re on their turf.

9. The Site is provided as-is

We try to keep the Site accurate and available, but we provide it “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent the law allows. We don’t warrant that the Site will be uninterrupted, error-free, or that anything on it is accurate or current.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or goodwill, arising from your use of the Site. Some jurisdictions don’t allow these limits, in which case they apply to you only as far as the law permits.

11. Indemnity

If you break these terms or misuse the Site and that causes a claim against us, you agree to cover our reasonable costs in dealing with it.

12. Age

This Site is intended for adults. Some of it involves alcohol as a punchline. Please don’t use it if you’re under 18, and don’t send us submissions if you’re under 18.

13. Privacy

How we handle information is set out in the Privacy Policy. The short version: we don’t sell resident data, and advertisers buy access to communities and placements, never to a list of names.

14. Changes

We may update these terms. If we change something material we’ll update the date at the top and say so in the newsletter. Continuing to use the Site after a change means you accept it.
